A VIOLÊNCIA DE GÊNERO, O MINISTÉRIO PÚBLICO E A APLICAÇÃO DA LEI MARIA DA PENHA: uma análise na cidade de São Luís/MA

Abstract

The research, GENDER VIOLENCE, THE PUBLIC MINISTRY AND THE ENFORCEMENT OF LEI MARIA DA PENHA: is an analysis in the city of São Luís/MA, it aims to discuss how the Brazilian Prosecutorial Attorney's General Office Public Ministry (Ministério Público) enforces the protection through the interpretation and the decision making proceedings expressed on the aforementioned statute in the capital of the Brazilian state of Maranhão in dealing with domestic violence against women, and thus seeking for the comprehension of its opportunities and challenges. It takes the violence against women as a type of gender violence and as part of a broader process of oppression, exploitation and subordination to which these women are victims in virtually all spheres of the social life and unfolded by a struggle carried out by the women and some feminists who have long claimed for the tackling of such violence. From the benchmarks of dialectical and historical materialism and open critical rationalism, it takes the Law 11.340/2006 with its differentiated instruments and procedural system for the prevention and repression of that kind of violence, as well as it takes the legal rules that are applicable by the Prosecutorial Office in order to measure its efficacy in São Luís/MA in the period between 2006 and 2013.
