Resumo: O trabalho aborda a efetividade da judicialização envolvendo a tutela do patrimônio cultural imobiliário, na Zona de Tombamento Federal, na cidade de São Luís, detentora do título de Patrimônio Cultural da Humanidade , concedido pela UNESCO, em 1997, em função da singularidade e harmonia de seu acervo arquitetônico, como já havia reconhecido o Instituto do Patrimônio Histórico e Artístico Nacional - IPHAN, em 1974. A problemática, portanto, consiste em indagar a razão pela qual as Instituições do Sistema de Justiça Federal não conseguem dar efetividade ao comando constitucional de tutela do patrimônio cultural. Para tanto, o trabalho analisa a gênese da questão patrimonial brasileira, em momento histórico no qual houve a necessidade de assunção de uma identidade própria, em que o aspecto do desenvolvimento econômico, impulsionado pelo Estado Novo, teve que se valer da cultura para conter os dissensos presentes na sociedade emergente. Dessa forma, o Estado se valeu de uma burocracia intelectualizada para levar adiante o seu projeto, o que deu margem a uma tecnocracia que passou a comandar a questão patrimonial. O trabalho considera essencial que as discussões sobre o patrimônio estejam associadas ao direito ao desenvolvimento cultural, o que, aliado ao desenvolvimento econômico, social e político, poderia levar a sociedade civil a uma maior emancipação e menor dependência estatal, diminuindo, consequentemente, os litígios patrimoniais que vão buscar solução no Judiciário. Essa procura pelo Judiciário é analisada em um contexto em que a teoria da separação das funções estatais alcançou nova perspectiva após a Constituição Federal de 1988, oportunidade em que se indaga se os juízes estariam desempenhando a função de administradores públicos, no campo dos conflitos da Administração Pública, bem como se estariam atuando como censores, em relação à sociedade civil. Para encerar, a pesquisa, por meio de dados empíricos e baseada nas teorias de Jürgen Habermas, ressalta que a judicialização não é capaz de resolver os conflitos patrimoniais, sendo necessário que o Estado se aproxime da sociedade civil, ouvindo-a e fomentando com ela um diálogo sincero, como forma de fortalecimento de tal política pública e como forma de consolidar um modelo de democracia emergente.
Abstract: The essay approaches the effectiveness of judicialisation involving the safeguard of protected real estate cultural heritage area, in São Luís, honored as Cultural Heritage of Humanity by UNESCO in 1997, due to its unique and harmonic architectural acquis, also recognized by IPHAN (abbreviation in Portuguese for National Institute for Historical and Artistic Heritage), in 1974. The issue consists in questioning the reason why the Federal Justice System cannot bring effectiveness to the constitutional commands for cultural heritage protection. Therefore the essay analyzes the genesis of Brazilian heritage matter, from a historical moment when the country needed to assume its identity, when the economical development, pushed by Estado Novo forced the cultural issue to be raised in order to stop the controversies of the emergent society. Thus, the State made use of intellectual bureaucracy to go ahead with its project, giving technocracy a chance for commanding heritage matter. The article considers extremely important heritage question is associated to the right for cultural development, which combined to economical, social and political development could lead society to emancipation and diminish the need for State interference, diminishing the cases as well. This search for Justice System is analyzed in a context in which the separation of State Functions achieved new perspective after 1988 Federal Constitution, when judges are questioned if they are acting like Public Administrators when solving conflicts involving Public Administration, and also if they are acting like censors towards citizens. Finally, by empirical data and based on Jünger Habermas Theories, the research accentuates that judicialisation is not able to solve heritage conflicts. Instead the State would better come closer to the society, by hearing its voices and suggesting a sincere dialogue, in order to strengthen this public policy and consolidate the emergent democracy as well.
