dc.description.resumoNo contexto do estupro, não é raro, que além dessa violação, a vítima ainda passe por um processo de estigmatização que a coloca como a verdadeira culpada pelo mal sofrido, sendo assim, a pesquisa tem como objetivo investigar o patriarcado na fundamentação da tutela oferecida pelo Sistema de Justiça Penal nos casos de crimes de estupro contra as mulheres silenciando a palavra da vítima e culpabilizando-a. A metodologia fundamenta-se na Análise de Conteúdo para embasar a abordagem quanti-qualitativa da pesquisa, analisa-se ainda 30 acórdãos de apelações criminais referentes á ações penais de estupro no Estado do Maranhão, dentro do mesmo período de 2017 a 2020 e faz-se uso, ainda, da Revisão Bibliográfica e Documental acerca dos temas mais relevantes que permeiam a questão central Debate-se o valor do gênero e do patriarcado como categoria de análise para descrever as características do tratamento estereotipado à mulher vítima de estupro, demonstrando a base patriarcal do funcionamento do Sistema de Justiça Penal Brasileiro que mitiga seu discurso garantidor e identificando como o Judiciário ressignifica essa violação sexual, culpabilizando a vítima com base em estigmas patriarcais ocultados sob o véu do discurso legal.por
dc.description.abstractIn the context of rape, it is not uncommon that, in addition to this violation, the victim still goes through a process of stigmatization that places her as the true culprit for the evil suffered, therefore, a research aims to investigate the patriarchy in the grounds of the tutelage offered by the Criminal Justice System in cases of rape crimes against women, silencing the victim's word and blaming her. The methodology is based on Content Analysis to support a quantitative and qualitative approach to the research. It also analyzes 30 judgments of criminal appeals related to rape criminal actions in the State of Maranhão, within the same period from 2017 to 2020 and whether to use, still, the Bibliographic and Documentary Review about the most relevant themes that permeate the central question The value of gender and patriarchy is debated as a category of analysis to characterize the characteristics of stereotyped treatment of rape victims, demonstrating the basis patriarchal of the functioning of the Brazilian Criminal Justice System that mitigates its guarantor discourse and identifying how the Judiciary resignifies this sexual violation, blaming the victim based on patriarchal stigmas hidden under the veil of legal discourse.eng
