O reconhecimento da multiparentalidade pelo Supremo Tribunal Federal na repercussão geral no 622, seus fundamentos e consequências

Abstract

The General Repercussion Thesis no 622, in which the Federal Supreme Court recognized multiparenthood, is analyzed in order to identify the legal foundations of this decision and its effects in the scope of Civil Law and on other branches of Law. Initially, the institute of multiparentality is conceptualized. Then, the arguments justifying the decision are verified. Finally, the legal impacts of the decision are investigated. It was concluded that the recognition

of multiparenthood gave rise to the admission of coexistence between the biological and socio- affective bonds of parents with their children and was justified in the right to seek happiness

and in the principles of responsible parenthood and family solidarity, all arising from the principle of dignity of the human person, impacting on various branches of law, by deconstructing the watertight model of the traditional family to reflect the most diverse parental arrangements existing in Brazilian society. The relevance of the work is demonstrated by the occurrence of consolidated factual situations, as well as by the absence of regulation of the institute by the legislature. The inductive method was used, through a qualitative approach, of a documentary, jurisprudential and bibliographic character, in addition to the content analysis of the votes of the Ministers in Extraordinary Appeal no 898.060/SC.
