Trabalho e transgressão no fazer dos oficiais de justiça

Abstract

The present research aims to get into the discussion about the court clerk´s transgression in the Maranhão State Court. In order that we sought to investigate the experiences of pleasure/suffering experienced by these workers, we discussed the role of transgression in a place marked by obedience to the laws and we identified the mediation strategies used by the bailiffs to do the real work and mediate the suffering. The research was guided by the theoretical contribution of the Psychodynamics of Work, for which the organization of work represents the way tasks are divided and allocated between the collective of workers, just as it is the prescriptions, the division of responsibilities, hierarchy, command and control. The investigation was carried out in the courthouse located in the city of Imperatriz. Nine officers from the judicial unit attended the study. In order to collect the data, a semi-structured interview was conducted aiming at raising elements, based on the workers' statements, about the phenomenon under study. The analysis and interpretation of the data used the technique of Norman Fairclough's critical analysis of speech, which sought to listen to employees' mistakes, contradictions, incomplete sayings, silences, etc. It was found that the transgression of the prescribed work is a constant in the daily work of the court clerk since the descriptions of the activities are generic. Although the transgression is frequent, it is not recognized by most professionals who commit it, as this could have negative consequences for them, such as public reprimand, verbal censure or even the communication of the case to the Judge- Director, requesting the opening of an inquiry process. As a result, it was observed the behaviour of seeking a ratification or referendum from a professional colleague, or even a requesting Judge, after issuing a behaviour that could be contested by one of the parties involved in the litigation. It is suggested that later studies investigate the transgression of judicial officers on duty and that a comparison will be made between the transgressions practised by the bailiffs in the two districts with court order´s office.
